Grow + Gather Terms of Service

1. Who We Are

Grow + Gather and its related brands (including our market, coffee shop, restaurant, urban farm, and private event venue) are operated by Grow + Gather LLC (“G+G,” “we,” “us,” or “our”).

2. Eligibility & Use of Our Services

You must be at least 13 years old to use our Services, and at least 18 to make purchases or bookings.
When you create an account, place an order, or book an event, you agree to provide accurate information and keep it updated.
You are responsible for all activity that occurs under your account.
We may modify, suspend, or discontinue any part of the Services at any time.

3. Online Ordering, Reservations & Event Bookings

3.1 Orders

Prices, fees, taxes, and availability are subject to change without notice.
All orders are subject to acceptance. We may refuse or cancel any order for reasons including product availability, suspected fraud, or errors in pricing.
If your order is canceled after payment, you’ll receive a refund to your original payment method.

3.2 Cancellations & Refunds

Food & Beverage: Because items are perishable and often made-to-order, cancellations and refunds are limited. Please contact support@growgather.com promptly if needed.
Classes, Experiences & Events: Tickets are non-refundable unless stated otherwise but are transferable. If we cancel, you’ll receive a full refund.
Private Events: Deposits/retainers are typically non-refundable. Specific terms will be stated in your event agreement.

3.3 Force Majeure

We’re not responsible for delays or failures to perform due to events beyond our reasonable control (e.g., severe weather, utility outages, public health directives). We’ll work with you in good faith to reschedule when possible.

4. Gift Cards, Promotions & Memberships

Gift cards are redeemable for eligible purchases and are not redeemable for cash except as required by law.
Promo codes and discounts are single-use unless stated otherwise.
Subscription services (e.g., produce boxes/CSA) have their own renewal, cancellation, and billing terms.

5. User Content & Reviews

You retain ownership of your content but grant G+G a worldwide, royalty-free license to use it in connection with our Services and marketing.
You represent that you own or have rights to the content you post.
We may remove or refuse any content at our discretion.

6. Acceptable Use

Do not misuse our Services (e.g., access non-public areas, scrape data, upload malware).
Do not post unlawful, misleading, defamatory, or harassing material.
Respect others, including staff, customers, and community members.

7. Intellectual Property

All website content, recipes, logos, graphics, and other materials are owned by G+G or its licensors. You may not copy, modify, distribute, or sell any part without permission.

8. Copyright / DMCA

If you believe material on our site infringes your copyright, email us at support@growgather.com with:

Your contact information
Identification of the copyrighted work
Identification of the infringing content
A statement of good faith belief
Your electronic or physical signature

9. Communications

By providing your email or phone number, you agree to receive transactional communications (order confirmations, event updates).
Marketing emails or texts require separate consent and can be opted out anytime.
Message and data rates may apply.

10. Third-Party Links & Services

We may link to or integrate with third-party services (e.g., payment processors, reservation platforms). We aren’t responsible for their content, policies, or practices.

11. Health, Allergens & Nutrition

Our products may contain or come into contact with common allergens. Cross-contact may occur. Please inform staff of allergies prior to ordering. We cannot guarantee allergen-free items.

12. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation.

13. Limitation of Liability

To the fullest extent permitted by law, G+G and its affiliates will not be liable for indirect, incidental, special, or consequential damages. Our total liability will not exceed the greater of $100 or the amount you paid for the related transaction.

14. Indemnification

You agree to indemnify and hold harmless G+G, its owners, employees, and agents from claims or damages arising from your use of the Services or violation of these Terms.

15. Dispute Resolution & Arbitration

Good Faith Effort: Contact support@growgather.com before filing a claim so we can attempt resolution within 30 days.
Arbitration: Unresolved disputes will be settled by binding arbitration under the American Arbitration Association (AAA) in Denver, Colorado, unless small claims court applies.
No Class Actions: You may only bring claims individually, not as a class member.
Opt-Out: You may opt out within 30 days of acceptance by sending written notice to Grow + Gather LLC, Attn: Legal.

16. Governing Law

These Terms are governed by Colorado law. Venue lies in Denver County, Colorado, unless arbitration applies.

17. Changes to Terms

We may update these Terms periodically. Continued use after updates means you accept the new Terms.

18. Termination

We may suspend or terminate your access at any time for violation of these Terms. Sections on intellectual property, liability, and dispute resolution survive termination.

19. Accessibility

We aim to make our website and services accessible to all. If you experience difficulty, please contact support@growgather.com.

20. International Use

Our Services are based in the United States and may not be appropriate or legal in other countries.

21. General

Entire Agreement: These Terms represent the full agreement between you and G+G.
Severability: If any provision is unenforceable, the rest remain valid.
Assignment: You may not transfer rights under these Terms without written consent.
No Waiver: Failure to enforce a term does not waive our right to enforce it later.
